Decibel Terms of Use

These Terms of Use (“Terms”) govern your use of the Decibel Meter mobile application (the “App”) developed and operated by Aksoy Labs (“we”, “our”, or “us”). By downloading, installing, or using the App, you agree to these Terms.

The version 2.1 feature descriptions below cover Decibel’s 2.1 releases; earlier TestFlight builds may differ. In versions 2.1.2 and later, access to the App’s tools requires Decibel Pro. Earlier installed versions may offer different features or purchase screens.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and the Apple Standard End User License Agreement (EULA).

3. Subscriptions and Purchases

In released version 2.1.0, basic sound measurement is free and requires neither a named account nor a purchase. Saving new measurements requires Decibel Pro, subject to free-save allowances preserved for eligible existing installations. Noise log includes a two-minute preview without saving; new saved logs and PDF/CSV export require Pro. Existing saved records and valid purchases are preserved.

Decibel Pro: available purchase options, local prices and introductory eligibility are shown in the App and Apple purchase sheet before purchase. A one-time Pro purchase does not automatically renew. Auto-renewing subscriptions renew for the period shown at purchase. Earlier valid subscriptions and purchases continue to follow their applicable terms; disabling renewal does not end access before the paid period expires. Restore Purchases is available in the App.

Auto-Renewal: All subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions: You can manage or cancel your subscription through your Apple account settings or the App Store. Cancellation stops future renewal; access continues through the current paid period. Deleting the App does not cancel a subscription.

Apple processes payments. We do not receive your payment card details. Refund requests follow Apple’s refund process and applicable law; these Terms do not remove mandatory consumer rights.

4. Accuracy Disclaimer

Decibel estimates sound levels using your device’s microphone. Results depend on the device, environment, selected measurement mode and calibration. The default version 2.1 meter shows unweighted estimates, not dB(A). Optional Precise mode is a beta feature that requires calibration against a reference sound level meter before use. Calibration adjusts readings; it does not make the App a certified sound level meter.

Do not rely on the App for: Occupational safety compliance or official regulatory measurements. Medical or audiological diagnosis of any condition including sleep apnea. Legal or regulatory noise assessments. Any situation where inaccurate measurements could result in harm.

Noise monitoring, sleep-related tools and hearing tools are for personal reference. Version 2.1 does not provide snoring classification or a medical hearing-age assessment. No feature is a substitute for professional assessment, certified measurement equipment or a dedicated safety monitor.

5. Health Information Disclaimer

The App is not a medical device. Its readings and any sleep or hearing tools must not be used to diagnose, treat or prevent a medical condition. Consult a qualified healthcare professional for medical advice.

6. Permitted Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to: Reverse engineer, decompile, or disassemble the App. Modify, adapt, or create derivative works based on the App. Use the App for any unlawful or unauthorized purpose. Attempt to interfere with the proper functioning of the App. Use the App to make recordings of other individuals without their knowledge or consent where required by applicable law.

The App allows you to record video with a real-time decibel overlay for the purpose of documenting noise conditions. You are responsible for complying with all applicable laws regarding video and audio recording in your jurisdiction.

7. Intellectual Property

All content, features, and functionality of the App including design, graphics, text, code, and the Decibel brand are owned by Aksoy Labs and are protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Aksoy Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes but is not limited to damages resulting from reliance on any measurement, snore score, hearing assessment, or other data provided by the App.

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

11. Apple Standard EULA

In addition to these Terms, your use of the App is also governed by the Apple Standard End User License Agreement (EULA). In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall prevail.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
