Intake — Terms of Use

These Terms of Use (“Terms”) govern your use of the Intake — Daily Health Coach mobile application (the “App”) developed and operated by Aksoy Labs (“we”, “our”, or “us”). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and the Apple Standard End User License Agreement (EULA).

3. Subscriptions & Purchases

The App offers optional Pro access through auto-renewable subscriptions:

Weekly Subscription: $3.99 per week, billed weekly through Apple.
Monthly Subscription: $8.99 per month, billed monthly through Apple.
Annual Subscription: $49.99 per year, billed annually through Apple.

Free Trial: All subscription plans include a 3-day free trial. The trial will automatically convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions: You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store. There is no refund for the unused portion of a subscription period.

All payments are processed by Apple. We do not have access to your payment information. For refund requests, please contact Apple Support.

4. Health & Nutritional Disclaimer

The App provides nutritional tracking, personalized goals, and AI-powered food analysis for informational and educational purposes only. The App is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Do not rely on the App for: medical or clinical nutritional guidance, diagnosis or treatment of any health condition, management of food allergies or intolerances, or critical dietary decisions for medical conditions (e.g., diabetes, kidney disease).

AI Food Analysis: The AI-powered food scanner provides estimated nutritional values based on image recognition. These estimates may be inaccurate and should be verified independently. We are not responsible for any health consequences resulting from reliance on AI-generated nutritional data.

Pregnancy & Breastfeeding Modes: The App offers adjusted nutritional recommendations for pregnancy and breastfeeding. These are general guidelines only. Always consult your healthcare provider for personalized guidance during pregnancy and breastfeeding.

Health Score: The Health Score feature is a general wellness indicator based on your tracked intake. It is not a clinical assessment and should not be interpreted as medical advice.

5. AI Food Scanner

When you use the AI food scanner, your food photos are sent to a third-party AI service (Google Gemini) for analysis. By using this feature: you consent to your food images being processed by Google’s AI services, you understand that nutritional estimates are approximate and may contain errors, you acknowledge that AI results should be verified especially for dietary restrictions or medical conditions, and you agree not to use the scanner for any purpose other than personal nutrition tracking.

6. Permitted Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to: reverse engineer, decompile, or disassemble the App, modify, adapt, or create derivative works based on the App, use the App for any unlawful or unauthorized purpose, attempt to interfere with the proper functioning of the App, abuse the AI food scanner (excessive automated requests), or share or distribute Pro features with non-subscribers.

7. Intellectual Property

All content, features, and functionality of the App (including but not limited to design, graphics, mascot characters, text, and code) are owned by Aksoy Labs and are protected by copyright, trademark, and other intellectual property laws. The mascot characters (Droppy and others) are original intellectual property of Aksoy Labs.

8. User Data

You retain ownership of all personal data you enter into the App. Your data is stored locally on your device. We do not claim any rights to your health data, nutrition logs, or personal information. For details on data handling, see our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Aksoy Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes but is not limited to damages resulting from: reliance on any nutritional data, goals, or recommendations provided by the App, inaccurate AI food analysis results, health decisions made based on the App’s information, or loss of data due to device failure or App malfunction.

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Apple Standard EULA

In addition to these Terms, your use of the App is also governed by the Apple Standard End User License Agreement (EULA). In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall prevail.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
