Intake — Terms of Use

These Terms of Use (“Terms”) govern your use of the Intake nutrition app (the “App”) developed and operated by Aksoy Labs (“we”, “our”, or “us”). These Terms cover Intake versions 1.1.3, 1.2, and 1.3. Features and service processing differ by version. By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and the Apple Standard End User License Agreement (EULA).

3. Subscriptions & Purchases

The App offers optional Intake Pro access through auto-renewable subscriptions. Available plans depend on your app version and the current App Store offering. Versions 1.2 and 1.3 present weekly and yearly plans to new subscribers. An existing subscription may continue under the terms shown in your Apple account even if that plan is no longer offered to new subscribers.

Before you confirm a purchase, the App Store purchase sheet shows the price in your local currency, billing period, any introductory offer for which Apple determines you are eligible, the offer duration, and the price and date of the first renewal. Introductory offers are not guaranteed for every person or plan. Review the purchase sheet before confirming.

Subscriptions renew automatically until canceled. You can manage or cancel a subscription through your Apple account settings or the App Store. Cancellation stops future renewals and does not immediately end access already paid for. Apple processes payments and handles refund requests under its policies; we do not receive your payment card number.

4. Health & Nutritional Disclaimer

The App provides nutrition logging, goals and optional AI food analysis; version 1.2 adds a training journal, and version 1.3 adds body-composition tracking, weekly check-in and target decisions, and optional sleep and recovery context. These features and their estimates are for general wellness, informational and educational purposes only. The App is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Do not rely on the App for: medical or clinical nutritional guidance, diagnosis or treatment of any health condition, management of food allergies or intolerances, or critical dietary decisions for medical conditions (e.g., diabetes, kidney disease).

AI Food Analysis: Nutrition values estimated from a food description or photo may be inaccurate. Review and edit the foods, portions, and values before saving. Do not rely on these estimates for allergies, medical conditions, or other critical dietary decisions.

5. AI Food Analysis

AI food analysis is optional. Version 1.1.3 sends a submitted food description or photo to Google Gemini directly or through Vibecode’s Gemini proxy, depending on build configuration. Versions 1.2 and 1.3 offer AI analysis through Pro and send requests through Intake’s analysis service to Google Gemini. The App shows an estimate for you to review before saving; analysis is subject to usage limits shown in the App. You can log food manually without using AI analysis. 6. Permitted Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to: reverse engineer, decompile, or disassemble the App, modify, adapt, or create derivative works based on the App, use the App for any unlawful or unauthorized purpose, attempt to interfere with the proper functioning of the App, abuse AI food analysis with excessive automated requests, or share or distribute Pro features with non-subscribers.

7. Intellectual Property

All content, features, and functionality of the App (including its design, graphics, text, and code) are owned by Aksoy Labs and are protected by copyright, trademark, and other intellectual property laws.

8. User Data

You retain ownership of the entries you make in the App. Your journal, goals and preferences, including version 1.2 training records and version 1.3 body measurements and check-in/target decisions, are stored on your device. These local records are included when you choose to create a backup. You can reset local app data or share a backup to a destination you choose. Sleep and recovery readings from Apple Health are cached only in memory and are not part of your journal or backup. Optional AI analysis, subscription checks, and service protection involve limited processing outside your device, as described in our Privacy Policy. We do not claim ownership of your personal entries.

Apple Health behavior depends on your version and permissions. Version 1.1.3 requests active-energy, step-count and body-mass read access and can write logged water and protein when Health is enabled. Version 1.2 reads workouts, including available workout energy, and optional body weight. Version 1.3 can read workouts, body mass, body-fat percentage, lean body mass, sleep analysis, HRV and resting heart rate. Versions 1.2 and 1.3 do not write to Apple Health. In version 1.3, workout and body-composition records stay local; limited workout metadata may be used for analytics. Sleep and recovery readings are held only in memory and are not persisted, backed up, uploaded or sent to analytics. You can change or revoke Health permissions in iOS Settings. 9. Limitation of Liability

To the maximum extent permitted by applicable law, Aksoy Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes but is not limited to damages resulting from: reliance on any nutritional data, goals, or recommendations provided by the App, inaccurate AI food analysis results, health decisions made based on the App’s information, or loss of data due to device failure or App malfunction.

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Apple Standard EULA

In addition to these Terms, your use of the App is also governed by the Apple Standard End User License Agreement (EULA). In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall prevail.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
